Tax preparation and planning for Bensonhurst

Two things recur. A business formed without anyone deciding what it should be for tax purposes, which usually means a default that costs money every year. And income or accounts abroad that nobody mentions until the return is nearly finished.

Foreign reporting has its own forms and its own penalties for silence, and the time to raise it is at the start of the engagement.

Local tax

New businesses and foreign reporting

Two things stand out here and both are evidenced rather than assumed.

First, roughly 29% of businesses on these corridors are under two years old. That is an unusually high rate of genuinely new business, and the work that goes with it is entity selection, registration, a bookkeeping system that will not need rebuilding in year three, and a first estimated tax calculation that does not produce a penalty. Getting the structure right in year one is worth more than any deduction found in year five.

Second, at 58.5% foreign born, Bensonhurst has the strongest case of any area we serve for foreign income and foreign asset compliance. FBAR, Form 8938, foreign pensions and ITIN applications are routine here rather than exceptional.

The 148 professional and medical service storefronts are a real S corporation and PLLC cluster, where reasonable compensation and the interaction with UBT matter. The restaurants bring sales tax, tip reporting and the FICA tip credit. Zone 1 for MCTMT at 0.60%.

How it works

How tax preparation and planning runs

Four stages. Most of the value sits in the first two, before anything is filed.

  1. Read the last few returns

Prior returns show the missed elections, the defensive positions and whether the entity still fits.

  2. Confirm the records

A return is only as good as the trial balance sitting behind it.

  3. Plan before year end

Entity, compensation, retirement and timing decisions, while they can still change the number.

  4. File and stay reachable

Returns prepared and filed, and someone who answers in August when a notice turns up.

Questions

Frequently asked questions

I am opening a business this year. What should I get right first?

Entity choice, a separate bank account and a bookkeeping system you will actually keep up. Those three decide how much everything else costs. Tax elections matter, but they are cheap to fix compared with a year of mixed personal and business records.

I send money to family abroad. Does that affect my return?

Sending money generally does not create tax. Holding accounts abroad, receiving large gifts from abroad or holding foreign pensions and investments can all create reporting obligations with real penalties. It is the holding and receiving side that needs checking, not the sending.

We run a restaurant. What gets missed most often?

Tip reporting and the FICA tip credit, which is a genuine credit a lot of operators never claim, and sales tax treatment where prepared food and grocery items sit side by side.

When is the right time to switch accountants?

Any time other than April. Moving mid-year gives us room to fix the books and act on what we find before the year closes. Moving in filing season means we file what already happened and start planning for next year.

Can you file returns for previous years I missed?

Yes. Prior-year and delinquent returns are routine. Filing voluntarily before the IRS contacts you nearly always produces a better outcome than waiting, both on penalties and on what options remain open.

Do you handle crypto?

Yes, including exchange activity, staking and the reporting that follows. Bring whatever transaction history you can export. Reconstructing it later costs more than keeping it as you go.

I live outside New York City but work in Manhattan. What do I owe the city?

As a nonresident, no New York City resident income tax. The nonresident earnings tax was repealed in 1999 and the partial version was struck down in 2000. But if you carry on an unincorporated business within the city, the Unincorporated Business Tax can still apply regardless of where you live. Westchester residents with city clients are the usual case.

Do you do foreign income and FBAR?

Yes. Foreign income, international reporting and FBAR filings for foreign accounts. The penalties for missing an FBAR are disproportionate to the effort of filing one, so it is worth checking even if you think you are under the threshold.
